Court to conduct treason case hearing against Musharraf on daily basis

The hearing of the case was adjourned until October 9.

ISLAMABAD (Dunya News) – Hearing of high treason case against former military dictator retired General Pervez Musharraf was held by a two-member bench headed by Justice Yawar Ali in a special court of Islamabad on Monday.

During the proceeding, the court decided that hearings on the case would take place on a daily basis from October 9.

“The case has to be taken to logical conclusion soon. The interior ministry should tell in writing how Musharraf can be produced in the court. Can he only be brought back via Interpol?” asked Justice Yawar.

Prosecution lawyer Nasser-ud-Din Nayyer appeared before the court. However; the prosecution head Mohammad Akram Sheikh recused himself from fighting the case.

The judge asked Nayyer to play the role of prosecution on the case.. “The prosecution should guide the court whether Musharraf’s statement can be recorded on skype or not. How the case will proceed if neither the suspect appears before the court nor his statement is recorded?” resented the judge.

The hearing of the case was adjourned until October 9.


Extra-constitutional emergency


The case pertains to the imposition of extra-constitutional emergency in the country in 2007. The special court indicted Gen Musharraf for high treason in March 2014.

The special court declared the accused a proclaimed offender and ordered confiscation of his properties which could not be attached due to the litigation in courts.

It ordered that Gen Musharraf’s computerised national identity card (CNIC) and passport be blocked. The outgoing PML-N government in May executed the court order and blocked his CNIC and passport.

However, Chief Justice of Pakistan Mian Saqib Nisar, during hearing of a case related to disqualification of Gen Musharraf, allowed him to return and restored his travel documents.

The Pakistan Muslim League-Nawaz government had appointed Akram Sheikh as head of the prosecution in the high treason case in November 2013.

However; he tendered his resignation in July this year expressing his inability to proceed with the case after the imminent change of government at the Centre.
