SHC complies to Supreme Court's order, halts Moon Garden residents eviction

A multi-storey complex was illegally constructed on Railways Housing Scheme

KARACHI (Dunya News) – Sindh High Court (SHC) on Wednesday has barred authorities from evacuating the flats until told otherwise while hearing of the case was adjourned until December 3.

Divisional bench comprising of Justice Sajjad Ali Shah and Justice Junaid Ghuffar heard the case. The high court ordered a court official to visit the flats and compile a report on the matter.

Justice Shah said that the high court wants to implement upon orders of the Supreme Court (SC) of Pakistan.

Earlier, the SC had annulled SHC’s order to demolish and seal the apartments. It should be mentioned here that a multi-storey complex was illegally constructed on Railways Housing Scheme. The court also ordered the builder to deposit at least Rs 50 million cash and the same amount as bank guarantee.

Moon Garden residents had spent at least two nights out in the cold. The protesters had said that they are being punished of a fraud that the builder is responsible.

Pakistan Tehreek-e-Insaf (PTI) had moved a resolution in the Sindh Assembly that stated, Federal Investigation Agency (FIA) and National Accountability Bureau (NAB) should take notice of the alleged corruption and take action against government employees involved in the case.

Documents received by Dunya News show that the building was being constructed for ten years and as per the documents, the Cantonment Board had approved maps of project’s Block A and B while the KCE approved the maps of blocks C, D, E and F.

On November 16, the district government had completed a survey in the matter on SC s directives. The survey, supervised by Assistant Commissioner Gulshan Iqbal Shaukat Ali, was carried out by the personnel of Karachi Metropolitan Corporation (KMC), Karachi Development Authority (KDA) and Board of Revenue while the officials of railway and builders were absent on this occasion despite the call from SC.
