SC allows Raheela Magsi to vote for Senate's chairman, deputy chairman
SC has directed the IHC to give a final verdict in 15 days regarding Raheela Magsi's case.
ISLAMABAD (Dunya News) – Supreme Court (SC) has conditionally allowed Pakistan Muslim League-Nawaz (PML-N) Senator Raheela Magsi to cast her vote for the selection of chairman and deputy chairman senate, Dunya News reported on Wednesday.
According to details, a three-member bench headed by Justice Anwar Zaheer Jamali conducted a hearing on the appeal of Raheela Magsi against the decision of Islamabad High Court (IHC) and sent the case to IHC for a final verdict.
SC has directed the IHC to give a final verdict in 15 days however, if the decision is not carried out in the fixed time the Election Commission (EC) should issue notification to Raheela Magsi whereas if the voting is preceded in the 15 days span, then Magsi will be allowed to vote for the selection of chairman and deputy chairman senate.
Aitzaz Ahsan, lawyer of PPP leader Nargis Faiz Malik who had challenged the nomination of Magsi before the Election Commission (EC), told the court that the decision of IHC was given after the consent of both the parties; therefore, such decision cannot be appealed in the SC.
He stated that Raheela Magsi belongs to Sindh but has been nominated as Senator from Islamabad which is a fraud with the constitution.
Justice Anwar Zaheer Jamali remarked that it is a fraud morally but there is no such restriction in law in this regard.
