Web Desk - Amber Heard asked for a second defamation trial against Johnny Depp after her attorneys said the verdict would have a "chilling effect."

Amber Heard recently requested a new defamation trial against her ex-husband Johnny Depp in response to current developments. This comes nearly five months after the judgment. She claims that the prior court case in Virginia, which she lost to the Pirates of the Caribbean actor, was conducted improperly. “The ruling will have a “chilling effect” on women who wish to stand up and speak out against abuse by prominent men”, according to the appeal submitted by Amber s attorneys Jay Ward Brown and David L. Axelrod.

“The trial court erroneously refused to dismiss this action on the ground of forum non conveniens, based on its mistaken conclusion that Depp s claims arose in Virginia because the Washington Post s servers are located here,” reads the new appeal that Amber Heard’s attorneys Jay Ward Brown and David L. Axelrod submitted to the court, according to Deadline. The trial court made a mistake when it rejected Heard’s demurrer, in which she claimed that the challenged statements are non-actionable expressions of opinion and are not capable of conveying the alleged defamatory implication.

“That holding, if allowed to stand, surely will have a chilling effect on other women who desire to speak about abuse involving prominent males,” the 68-page record continued. The appeal by Amber’s attorneys uncovered several statements mentioning that the trial has taken place in an erroneous format.

According to the application, “This case also should never have gone to trial because another court had already found that Depp had assaulted Heard repeatedly. The United Kingdom High Court of Justice decided that Heard’s abuse allegations were true”, after Depp filed this lawsuit in a separate defamation case.

Case involving Johnny Depp and Amber Heard’s defamaton case

The defamation case trial concluded in June 2022. Depp received USD 10 million in compensatory damages and USD 5 million in punitive damages from Heard as a result of the jury’s decision. Amber, on the other hand, received USD 2 million in compensatory damages, but not a penny in punitive damages from Depp.
