Petitioner requests court to rectify “omission of not recording contention of learned counsel

ISLAMABAD (Dunya News) - PTI chairman on Thursday filed a petition in the Islamabad High Court (IHC) for suspension of the trial court verdict in the Toshakhana case.

A month earlier, the IHC had suspended PTI chief’s three-year sentence in the Toshakhana case.

A trial court in Islamabad had declared the PTI chief as guilty of “corrupt practices” for concealing details of state gifts and sentenced him to three years in prison.

The IHC had suspended PTI chairman’s sentence in the Toshakhana case but he was detained again this time in the cipher case. He has since remained in jail on judicial remand, which was extended until October 10.

The former prime minister, through senior lawyer Sardar Latif Khosa, approached the IHC against Toshakhana verdict under section 561-A (saving of inherent power of high court) of the Code of Criminal Procedure.

The petitioner sought “rectification of the order dated August 28 to the extent of suspending the operation of the impugned order along with the sentence as verbally prayed by the learned counsel for petitioner before this honourable court at the time of arguments”.

The petitioner requested the court to rectify the “omission of not recording contention of the learned counsel for petitioner.

The petition further requested the IHC that operation of the same order be “suspended/stayed till final decision of the appeal”.
