Single bench's decision to get prior permission for making arrest under 3 MPO suspended

Public prosecutor says constitution, law authorised detention without reason

LAHORE (Dunya News) – A division bench of the Lahore High Court on Wednesday suspended the single bench decision to seek prior court permission for making any arrest under 3 MPO. 

The division bench comprising Justice Jawad Hassan and Justice Mirza Waqas Rauf of the Lahore High Court suspended the single bench decision on the appeal of the deputy commissioner. 

The release of 57 detained PTI workers has also been delayed due to suspension of the decision issued by the single bench. The authority of the deputy commissioner to detain any person and worker at any time without permission has been restored. 

During the hearing, the public prosecutor said the constitution and law had authorised detention without reason, which could not be terminated or suspended.
“If the deputy commissioner's discretionary power of detention ends, its utility and importance will also end.

He requested the court that decision of the single bench to make the detention conditional under the 3 MPO should be annulled. Later, the division bench suspended the single bench judgement and issued notice to the parties seeking their reply within two weeks.
