SHC declares amendments in LB act illegal, unconstitutional

Summary Sindh government has decided to approach SC against the decision of Sindh High Court.

KARACHI (Web Desk) - Sindh High Court has declared Sindh Local Government Act-2013 as unconstitutional and illegal, Dunya News reported on Monday.

The two-member bench comprising Justice Sajjad Ali Shah and Justice Farooq issued a 78-page order today on ten identical petitions challenging the amendments in the local bodies act.

MQM‚ PML-N‚ PML-F and others had challenged the amendments in Sindh Local Government Act-2013 and the delimitation carried out in the province.

The division bench while declaring the Sindh Government delimitations notification issued in November 2013 as null and void‚ directed the Sindh Government to hold local bodies’ elections in accordance with 2001 delimitation.

Meanwhile Advocate General Sindh Khalid Javed has said Sindh government will file an appeal in the Supreme Court against the Sindh High Court’s decision.

He said it will be impossible to hold local bodies’ elections as per schedule on old delimitations.

Chief Minister Sindh‚ Syed Qaim Ali Shah said that Sindh government will approach Supreme Court against the decision of Sindh High Court.

Talking to media in Sukkur today‚ he said that law experts would be consulted on the decision of the high court.

On the other hand, Election Commission has hinted that schedule of Sindh local bodies election could be nullified in the backdrop of SHC order.

Now, the issue of delimitation of constituencies goes back to Local Government Ordinance 2001, thus, new law cannot apply on old delimitations, the Election Commission stated.
