Summary CJP says the precious land allotted for the purpose of agriculture farms has been misused.
ISLAMABAD (Online) - Supreme Court has stopped operation by Capital Development Authority against constructions made on agriculture farms having more than 4500 square feet area.
The court directed Attorney General Munir A Malik to obtain directives from the federal government in connection with tempering of master plan and utilization of agriculture farm for residential purpose and file the reply with it.
Court directed chairman CDA to assist AG in this matter besides presenting report in respect of the allottees found involved in using the agriculture farms for residential purpose individually.
A three-member of SC presided over by the Chief Justice of Pakistan Iftikhar Muhammad Chaudhry took up the case for hearing Wednesday.
CJP remarked “people have built swimming pools and posh homes in the precious land allotted for the purpose of agriculture farms and this way they have defeated the real purpose. People were allowed to do whatever they willed.
AG and senior officers of CDA appeared in the court. The court was told from CDA that the report had been filed with it.
CJP remarked CDA undid the decision taken in 2004 by declaring it illegal on its own. CDA will have to face the implications in this regard. IG level police officers are involved in occupation of lands.
Police vans were sent overnight and the lands were occupied. Who will compensate for the mistake committed by CDA board. If SC will issue any order or government will find any solution to it.
Justice Ejaz Chaudhry remarked “agriculture farms were leased out at low rates during PPP and Musharraf regimes. Those who could not get the land on lease adopted the way of purchasing these land from their allottees and they built their palaces therein.
Justice Gulzar Ahmad remarked “CDA had allotted the land on lease but the allottees have considered them permanent owners of these plots. What will CDA do if the lease expires.
Mustafain Kazmi said a scrutiny committee has been constituted to end the occupation and these plots have to be retrieved. All the land record is being computerized and steps are being taken against the land mafia. Islamabad police is not cooperating in bringing to end the occupations.
