Summary The SC disposed of Husain Haqqani's petition seeking recording of his statement via video link.
It observed that it was upto the commission to record the testimony of Haqqani from abroad or summon him in the country for the purpose.The court in its order stated the order of Supreme Court, on January 30, 2012 is intact, the commission without prejudice in the case of any body may adopt a procedure for recording of statement in the interest of justice as desired by it.The nine-member bench headed by Chief Justice Iftikhar Muhammad Chaudhry resumed hearing of the application filed by Hussain Haqqani through his counsel Asma Jahangir, seeking recording of his statement via video in abroad.During the proceedings, Asma Jahangir apprised the bench that the apex Courts order dated January 30 did not bar the commission to extend the same facility to Hussain Haqqani which was given to Mansoor Ijaz regarding the recording of statement via vide link. However, juctice was not done to her client by denying the video link facility.Asma pointed out that there was nothing left against her client in the case as Mansoor in his statement recorded to the commission, had admitted that he drafted the memo himself not Haqqani.She contended that Haqqani always cooperated with the commission and requested for recording Haqqanis statement in abroad
