President Asif Ali Zardari appointed Justice Sarmad Jalal Osmani as Chief Justice Sindh High Court and also elevated Chief Justice Sindh High Court Justice Anwar Zaheer Jamali as Judge Supreme Court of Pakistan. Justice Sarmad Jalal Osmani and Justice Anwar Zaheer Jamali were judges of the Sindh High Court. Both these judges refused to take oath under the PCO on 3rd November due to which Justice Mohammad Afzal Soomro was appointed as the Chief Justice Sindh High Court. Later, on 27th August 2008, Justice Anwar Zaheer Jamali re-took the oath and was appointed as Chief Justice Sindh High Court. Justice Sarmad Jalal Osmani was among the 14 member bench of Supreme Court which announced the decision against PCO judges. According to this decision, if any High Court judge appointed to the Supreme Court by Chief Justice Abdul Hameed Dogar, will have to return to the High Court from Supreme Court. Justice Sarmad Jalal Osmani was being directly affected from this decision, so the President has elevated him as Chief Justice Sindh High Court, where as Chief Justice Sindh High Court Anwar Zaheer Jamali has been appointed as Supreme Court judge.
