PCO judges case: Targeting Dogar tantamount to discrimination

Justice Abdul Hameed Dogars counsel Ibrahim Satti on Friday told the court that contempt accusations of one judge on the other is not possible and such an act would set a wrong precedent. A four-member bench, comprising Justice Mahmood Akhtar Shahid Siddiqui, Justice Jawwad S Khawaja, Justice Khilji Arif Hussain and Justice Tariq Pervez heard the case. During the course of hearing, Justice Doagrs counsel Ibrahim Satti argued that currently there are 6 sitting judges also took oath under PCO and thus targeting Justice Dogar would be tantamount to discrimination. He further stated that the November 6 order was signed not by 7 but 6 judges as Justice Rana Bhgwandas was not present in Islamabad at that time. Justice Khilji Arif Hussain askedSatti whether he accepted Nov 3rd order. Satti told him that in the wake of the Emergency, the judges who took oath did it after accepting the said orders. No judge can accuse his fellow judge of contempt; otherwise same allegation would be leveled against you after retirement, Satti said. The case has been deferred till Monday.
