Justice Naqvi is facing multiple references over alleged audio leaks

QUETTA (Dunya News) – Two Supreme Court judges, Justice Qazi Faez Isa, and Justice Sardar Tariq Masood wrote to Chief Justice of Pakistan (CJP) Umar Ata Bandial on Monday to convene a meeting of the Supreme Judicial Council (SJC) to probe into the allegations made against SC judge Justice Mazahir Ali Naqvi.

Mr Naqvi came in the spotlight after Interior Minister Rana Sanaullah released an audio of an alleged conversation between the top court’s judge and former Punjab chief minister Parvez Elahi. On the other hand, the judge and his family members had been accused of malpractices and misuse of power in a criminal designed pattern during his service.

If the reference did not contain solid evidence against Justice Naqvi, the judge should be acquitted and if the judge was not set free, a report must be sent per the law, the letter read. ‘The aim was to preserve the sanctity of the judge and the judiciary in any case, the letter stated.

The letter comes as Balochistan Bar on Monday moved the SJC to file a reference against Justice Naqvi.

The reference sought a probe into Justice Naqvi’s assets after it observed that the judge’s audio leaks, tantamount to the violation of the code of conduct, had helped invite questions on the judiciary’s dignity and independence. “Justice Naqvi must be proceeded under Article 209 and be removed from his post”, the reference read.

Earlier, the Pakistan Bar Council had also filed a reference against Justice Naqvi over the audio leak while adding proceedings of misconduct to be initiated against the judge. As per the Pakistan Bar Council, Justice Naqvi violated the code of conduct and asked for strict action against him under Article 209.

The PBC also demanded the resignation of Justice Naqvi over the alleged audio leak.
