Ten-member bench, headed by Justice Umar Ata Bandial, handed a split 6-4 verdict

ISLAMABAD (Dunya News) – Supreme Court of Pakistan has accepted review petitions filed by Justice Qazi Faez Isa, his wife Sarina Isa and lawyer bodies against presidential reference.

According to details, ten-member bench, headed by Justice Umar Ata Bandial, handed a split 6-4 verdict after all parties to the case concluded their arguments.

The apex court order said that no action could be taken against the wife and children of Justice Qazi Faez Isa. Justices Bandial, Sajjad Ali Shah, Munib Akhtar and Qazi Amin disagreed with the decision.

Justice Manzoor Ahmad Malik and Justice Mazhar Alam MianKhel retracted from their decision to send the cases to the FBR in the review petition meanwhile, new member of the bench, Justice Amin-Ud-Din Khan also supported the review petition.

Earlier on June 19, Supreme Court rejected the presidential reference against Justice Qazi Faez Isa and withdrew the show-cause notice against Justice Isa.

Seven judges referred matter to the FBR for tax proceedings against Justice Qazi Faez Isa’s wife and children, however, three judges Justice Baqar, Justice Mansoor and Justice Yahya did not endorse majority view to refer matter to FBR.

Later, Justice Isa filed a review petition against the June 19 verdict and sought that the Supreme Court reviews the decision and quash the earlier order. The execution of the court decision should be stayed till the decision on the review application.
