IHC warns of legal action against negligence in SOPs' implementation
ISLAMABAD (Dunya News) - The Islamabad High Court (IHC) has upheld the decision of the National Command and Operations Center (NCOC) and said that there would be legal action against negligence in the implementation of coronavirus SOPs.
According to details, the Islamabad High Court has issued the detailed verdict of the case against the ban on indoor wedding events. The 8-page decision was penned by Chief Justice Islamabad High Court (IHC) Justice Athar Minallah.
The written decision states that the court does not wish to interfere in executive matters, therefore, the application is disposed of. The court cannot interfere in the decisions of the NCOC as they have been taken in the larger public interest. It is the duty of every citizen to implement the decisions of the National Committee, the court remarked.
It said that overcrowding in prisons across the country has led to fears of another outbreak. There are many under-trial prisoners in jails who are later proved innocent, the court expects the NCOC to take steps to provide medical care and protect the prisoners.
The court said that the 19th session of NCOC had banned gatherings of more than 300 people, those violating the decision will have to face legal action.
The court made the NCOC orders part of its decision and wrote in its judgment that the responsibility of ensuring SOP implementation would fall on the organizers of any event. The relevant organizer will be held accountable for spreading the virus and any loss of life because of these gatherings. Lawsuits and cases against SOP violating organizers will also be possible, the court said.
Giving clear instructions in its decision, the Islamabad High Court said that the political leadership must prove its responsibility in the current situation and not contribute in the spread of the virus.
