LHC permits dual nationality holder PTI's candidate to contest cantt election
The LHC annulled appellate tribunal's verdict
LAHORE (Dunya News) – The Lahore High Court (LHC) on Thursday has permitted American born Pakistani, dual citizenship holder Pakistan Tehreek-e-Insaf (PTI) candidate Khawaja Muhammad Naseer to contest in the cantonment board elections.
Justice Syed Mansoor Ali Shah held hearing of Naseer’s plea. The petitioner’s counsel said that Pakistan Muslim League-Nawaz (PML-N) candidate had challenged his client’s participation in election due to his dual nationality along with the returning officer (RO).
The election appellate tribunal and the RO had barred his client to contest in the election under the Article 63 which is unconstitutional, he added. The counsel said that the Article 63-C bars candidates for the parliament from contesting the elections and not the cantonment board elections.
Deputy Attorney General said that the Cantonment Board Local Body Rules permit dual nationality holders to take part in the elections.
The LHC annulled appellate tribunal’s verdict and permitted Naseer to participate in the Sialkot Cantonment Ward number one elections.
