Treason case: IHC issues notice to Attorney General
Justice Minallah sought a response regarding petition against special court's decision within a week
ISLAMABAD (Dunya News)—Islamabad High Court issued a notice to Attorney General Salman Butt over the plea against the decision of special court regarding Pervez Musharraf’s treason case. Justice Athar Minallah remarked that the special court has a similar status to that of the high court; therefore, its decision can’t be challenged.
Justice Athar Minallah of Islamabad High Court heard the petition filed by Advocate Taufeeq Asif against the decision announced by the special court on November 21 regarding Pervez Musharraf’s treason case.
During the hearing of the petition, the petitioner Asif argued that the decision to include in the trial, the co-accused in Musharraf’s treason case should be made void. Musharraf’s trial should be completed soon and the trial of co-accused should be held separately. He said that the decision was violating the legal requirements and would benefit Musharraf.
Justice Minallah issued a notice to Attorney General Salman Butt ordering to submit a response within a week. He said that the issues raised in the petition must be resolved since the decision by special court cant be challenged.
According to Special Court Act only final order can be challenged in the court. He also remarked that decision is yet to be taken about whether the petition is admissible or not. Attorney General would comment on this matter. The case hearing was adjourned till next week.
