Marriage annulment based on 2nd marriage is against Shariah: Maulana Sherani

ISLAMABAD (Dunya News) – The religious advisory body to the government Islamic Ideology Council’s (IIC) chairman Maulana Muhammad Khan Sherani on Tuesday said that annulling marriage on the basis of second marriage should be avoided and abolished from the law because “it is against Shariah”, Dunya News reported.

The IIC met in Islamabad for the 196th time under headship of Maulana Sherani. The session discussed subjects like Dissolution of Muslim Marriages Act 1939, Protection of Pakistan Ordinance, National Security Policy, code of conduct to prevent sectarian violence and sex education content in the school curriculums.

After the session, Sherani, while talking exclusively to Dunya News, said that annulling marriage for the reasons of second marriage must be avoided. He said that husband’s imprisonment for seven years should also not be the basis for annulment of marriage “because an individual convicted of a crime is worthy of mercy”.

Maulana Sherani said that the wife has the right to annulment of marriage only if the husband fails to fulfill his marital responsibilities and treats the wife with cruelty.

Sherani also said that marriage in childhood is permissible as long as it is not performed under forbidden traditions such as Wani, Sawara etc but the consummation is not allowed until the married girl reaches the age of 18.
