SCBA terms Toshakhana verdict against justice, legal principles

ISLAMABAD (Dunya News) – The Supreme Court Bar Association reacted on Saturday to the arrest of PTI chairman in the Toshakhana case.

In a joint statement, the President and Secretary of the Supreme Court Bar said that it was unfortunate that the court gave its verdict without giving the accused a fair opportunity to be heard, deciding the case in haste in the absence of the PTI chairman's counsel.

Thus, it was a clear violation of the fundamental rights of the accused under Article 4, that the judgment had been delivered in haste without hearing counsel.

They further added that the high court had directed the Additional Sessions Judge to decide the issue of admissibility afresh and, instead, the learned Judge hastily rejected the application relying on his own earlier orders.

The SCBA highlighted that the maximum sentence was given to the accused under the law mentioning that the hasty decision was against all settled principles of justice, natural justice and due process of law.
