NAB must possess concrete evidence before arrest, rules IHC

ISLAMABAD (Dunya News) – Islamabad High Court has termed the discretional power of NAB to issue arrest warrant a violation of fundamental constitutional rights.

The court in its 56-page detailed judgment in alleged corruption case in 4G licenses, said that accused cannot be arrested without concrete evidence of involvement in the crime.

The judgment further states that NAB should have evidence that links the accused to the crime and proof of his intention to take financial advantage.

The court further stated that misuse of NAB’s powers is having a negative impact on the economy and indiscriminate accountability is necessary to get rid of corruption.

IHC further ruled that excessive use of NAB’s arrest power is also harmful to the public interest and governance.
