ICJ denies India 6-month injunction over Jadhav's execution

THE HAGUE (Dunya News) – International Court of Justice (ICJ) has rejected Indian plea of granting injunction order against convicted spy, Kulbhushan Jadhav for six months and has ordered the state to file case by September 13 this year, sources reported on Thursday.

The international court is likely to hear death row inmate Jadhav’s case in January 2018.

Reportedly, ICJ has ordered India to file a case by September 13 and has granted Pakistan time until December 13 to file a reply.

Sources have reported that office of the registrar of the International Court of Justice has formally informed the Government of Pakistan about the development.

India took to the international court in May seeking stay to convicted spy’s execution upon which the panel ordered Pakistan to halt implementation of the verdict of the military court until further order.

ICJ admitted during the hearing earlier that Pakistan proved Jadhav s Indian citizenship, and stated that he did not appeal against the sentence during the 40-day period. India could only be given relief after providing sufficient evidences as Article 36 of Vienna Convention does not apply on this case, remarked the president.

Pakistan had maintained that it was beyond jurisdiction of the court to hear such a case.

Counsel for Pakistan Khawar Qureshi maintained that responsibility to punish terrorists lies with all of the countries. Qureshi said that the issue at hand concerns national stability of Pakistan and ICJ does not have the jurisdiction to rule over such case.

Kulbhushan Jadhav, an in-service Indian navy officer, working for the Research and Analysis Wing (RAW), an intelligence agency of the arch rival, was nabbed in March in 2016 in Balochistan.

He later confessed to have been tasked to work to destabilize China-Pakistan Economic Corridor (CPEC) and fan unrest in the country.
