Justice Jamali's era can't be praised: Ali Ahmad Kurd
Kurd said Iftikhar Chaudhry major reason due to which the system hasn't improved as all
KARACHI: (Web Desk, Dunya News) – Senior lawyer Ali Ahmad Kurd has on Thursday said that Chief Justice Anwar Zaheer Jamali’s era cannot be praised, reported Dunya News.
Talking to Dunya News on Aaj Kamran Khay Kay Saath, Kurd said that one of the major reasons due to which our judicial system wasn’t improving was the era of former chief justice Iftikhar Muhammad Chaudhry.
“Whenever I’m before the camera, the one thing I feel very strongly about is that I have to speak the truth because people are listening. And if I speak the truth here, it is that Anwar Zaheer Jamali’s tenure as Chief Justice of Pakistan wouldn’t be remembered in good words”.
Kamran Khan said that this could be because Jamali didn’t allow the judiciary to be involved into anything controversial during his tenure. “However, this attitude has been the same ever since Iftikhar Chaudhry left. Justice Jawad S Khawaja, Nasir ul-Mulk, Anwar Zaheer Jamali all remained away from controversies. It seems the era of judicial activism was limited to Iftikhar Chaudhry’s seat alone”, he said.
Kurd disagreed with Kamran Khan on the subject. He said that Iftikhar Chaudhry’s judicial activism was not for justice. “The cases he took up, he didn’t take them up for the cause of justice. I regret saying that when I say that the system isn’t going in the right direction, one of the biggest reasons for it is Iftokhar Chaudhry’s tenure”, he said.
“Had Iftikhar Chaudhry used the apex court for the sake of justice, Pakistan’s judicial system would have evolved to a much better position today. But I have to say this that he focused controversies mainly for the sake of media. The reason he took up those cases was media”.
He advised the upcoming judges to focus primarily on the pending cases. “There are hundreds of thousands of cases pending in the lower and upper courts. It takes even ten years for the courts to decide simple cases. This is the biggest problem in Pakistan today”, he said.
