Summary Says unregistered companies can’t demand general sales tax (GST).
ISLAMABAD (Dunya News):-Chief Justice Iftikhar Muhammad Chudhry remarked that according to newspapers reports, about 90 percent business is unregistered.
Three-member bench of the Supreme Court headed by Chief Justice resumed hearing of GST suo motu notice and while passing his remarks said that GST is the tax out of which the government would take direct benefit. Businessmen would have no relief from it.
He added that there is not only raise in petroleum prices but all items for daily usage have also been made costly.
Chief Justice sought an explanation that how possible to recover from unregistered companies.
He made it clear that unregistered petrol pumps are defaulter in the view of law but they are imposing undue burden on consumers. Unregistered companies are collecting money out of consumers but not depositing in national exchequer, said Chief Justice, adding that visit market places and shopping malls and see that prices of everything have been increased unscrupulously while poor people are unwillingly bound to pay the amount for things.
Chief Justice also directed the FBR and government to take revolutionary steps for security of people from exploitation.
He consulted as why the government has taken back the notification of 2 percent additional GST on petrol pumps owners.
While replying a query, FBR counsel told that the court that 70 items including cooking oil, peppers, seeds and sugarcane are exempted from GST.
The Chief Justice ordered the counsel to submit comprehensive report in the court regarding GST sale tax on next hearing.
