Chief Justice Iftikhar Muhammad Chaudhry has not separated himself from the bench that will hear the unconditional apology and contempt of court cases of PCO judges, including Dogar and Khosa rather he isnt hearing the petition under article 209, a statement issued by the Supreme Court has said. Earlier it was said that CJ has separated himself from the bench following objections by former Attorney General Latif Khan Khosa and former chief justice Abdul Hamid Dogar. Five-member bench, headed by most senior SC Judge Justice Khalilur Rehman Ramday and comprising Justice Nasirul Mulk, Justice Raja Fayyaz Ahmed, Justice S Khawaja and Ghulam Rabbani is hearing the petition. Talking to Dunya News Justice (R) Wajihuddin elaborated that if CJ had constituted a bench and kept himself aside then it couldnt be said he had separated himself from it.
