Summary Federal government is not a part of Reko Diq agreement, says Chief Justice
A three-member bench of apex court headed by chief justice Iftikhar Muhammad Chaudhry heard the Reko Diq case.
Chief justice remarked that the foreign companies made an agreement with Balochistan government. In such situation, how international arbitration is possible against Pakistani government.
Khalid Anwar, counsel for Tethiyan, said that bilateral agreements always guarantee an agreement with the state too.
Justice Gulzar replied that how can the state be responsible for an agreement it is not even aware of?
Chief justice said that the Balochistan government deviated from the agreement and not the federal government.
Ahmer Bilal Sufi, counsel for Balochistan government, said that non-issuance of new license can be considered against the investment protection.
The court directed counsel for Tehtiyan to complete his arguments by Monday and adjourned the hearing. .
