A four-member larger bench of the Supreme Court resumed the hearing of judges’ appointment case on Tuesday.
Akram Sheikh Advocate said that the Judicial Commission had recommended the 6-month service extension of Justice Shaukat Aziz and Justice Noor-ul-Haq of Islamabad High Court but the President did not issue the notification in this regard.
In his remarks, Justice Asif Saeed Khosa said that Article 175 of the Constitution does not mention President’s authority of rejecting the judges’ appointment.
Justice Afzal said the President does not have any other option but to issue the notification of the appointment.
In his arguments, Attorney General of Pakistan Irfan Qadir said that the Chief Justice was backing the filing of the case while the decision of the Judicial Commission can be dismissed. Upon this, Justice Asif Saeed said it means that anyone can reject the court decision.
Justice Khilji Arif inquired from the Attorney General if he was looking for any directions from the government in this matter.
When Justice Asif Saeed ordered the Attorney General to avoid adopting aggressive way of talking, Irfan Qadir said that he had throat problem due to which he had to speak loudly. The court adjouned the hearing till November 22.
