He was heading the three member jury.The former Director General Inter Services Intelligence (ISI) Lt. Gen(R) Asad Durrani told the court that he gave hefty amount of Rs 70 million to the politicians on the instructions of ex President Ghulam Ishaq Khan and Chief of Army Staff at that time, General Aslam Baig.The money was distributed through Brig Hamid Saeed.Former ISI Chief Durrani said in his statement that he was told that giving money to political leaders would be in national interest.Chief Justice Iftikhar Chaudhary said in his remarks that Gen Asad Durrani, while in uniform not only executed an unlawful act but also violated his oath of the office as a soldier and commander, however he appreciated him for tell truth to the court.CJP said that it is in the best national interest that army should protect the frontiers of the country.Electing the leaders is the function of the people, not army. It would be wrong to hold responsible army or ISI because of wrong action of a single man“President is head of entire country not any of any fraction or party like IJI.Today courts and parliament is performing their duties. Now many things have been clarified.Now free, fair and impartial elections are the need of the country”, Chief Justice added.Secretary Aiwan-e-Sadr Asif Hayat also appeared before the court, who informed the bench that the case pertained to that time, when Presidency was situated at Rawalpindi.“At present I do not know about the availability of old record, so the court may give some time to trace out the record.” he added. On which the court gave him time till Wednesday.Justice Jawad S. Khawaja said that the record presented before court has some clues of ISI’s Political Cell in the regime of former late presidents Ghulam Ishaq Khan and Farooq Ahmed Khan Laghari.He said that the whole country would be benefited, if the facts would be unveiled in the case. The court is searching the foundation of political cell in ISIFormer Bureaucrat Roidad Khan said in his written reply that he never met with General Aslam Baig throughout his life.He said that the former Secretary Defence Ijlal Haider Zaidi did not tell him about any political cell, which used to work on behalf of Aiwan-e-Sadr.Salman Raja Counsel of Air Marshal(R) Asghar Khan said during his argument said that former Army Chief General Waheed Kakar wrote that Aslam Baig and Asad Durrani tried to involve the army in the matter.
