Public Health Bill 2009 has been presented in NWFP Assembly under which it would be essential for couples to have tests of Hepatitis and Thalassemia before marriage. The bill was presented by ANP member Saqibullah Chimni. According to the bill, it would be necessary for the couples to have tests of Hepatitis and Thalassemia before the marriage. Under the bill, Nikkah registrars would ask the couples to submit reports of these tests. However, test results would have not any effect on the marriage. Nikkah registrars license will be canceled if they do not check the test reports. Any other person, instead of Nikkah registrars, who consummates Nikkah would be charged Rs 10,000 if he does not check the laboratory report. On the other hand, talking to Dunya News exclusively in this regard, Mufti Naeem Ahmed said, The tests are in accordance with Shariah if these diseases transform to others. But Nikkah will also be legal without checking any test reports because Shariah has not any such conditions for Nikah, he added.
