JUI-F's constitutional amendment draft comes to light

Special benches of SC will be formed to hear constitutional cases

ISLAMABAD (Dunya News) – JUI-F has made its draft on the proposed constitutional amendment public, Dunya News reported here on Saturday.

According to the draft, special benches of the Supreme Court will be formed to hear constitutional cases; constitutional bench will consist of Chief Justice of Pakistan and four senior judges.

The Jamiat Ulema-e-Islam has proposed to implement the 18th Amendment to the extent of appointing judges and proposed that the constitutional bench of the Supreme Court will be authorised to hear appeals against the decisions of the constitutional bench of High Courts. The hearing will be conducted by the constitution bench only.

The JUI-F has suggested that any legislation would require the approval of the Islamic Ideological Council.

It has also proposed the abolition of all forms of usury from January 1, 2028.

It has suggested the inclusion of chief justices of all the provincial high courts in the Supreme Judicial Council and also proposed action against incompetent judges.

In the proposal, the appointment of a new chairman of the Supreme Judicial Council is subject to the approval of a resolution by either house of the parliament, and the parliament will be bound to enact legislation within a year based on the reports of the Islamic Ideological Council.

In the proposed amendment, the extension of the tenure of service chiefs is subject to the approval of the Special Committee of the Parliament and it also proposed amendments to the Anti-Terrorism Act, 1997.
