SC moved for recovery of Arsalan-Riaz case expenses

A petition was filed in the SC for the recovery of expenses of Arsaln Iftikhar case.

 

ISLAMABAD (Online) - The Supreme Court has been moved for issuing orders for recovery from one or both parties to return the expenses incurred out of the apex court budget in the civil dispute between Malik Riaz Hussain and Arsalan Iftikhar.

 

The petitioner Shahid Orakzai took the plea in his petition filed on Thursday that all the annual expenses of apex court are met out of federal consolidated fund and the constitution does not authorize the national assembly to make deduction through voting.

 

The court was reminded that a commission constituted by it also incurred expenses in this case and precious time of 9 judges of SC was also spent while the case paid no dividend to the people and in terms of constitution.

 

Under article 184 of the constitution, the hearing of the civil suit is illegal and the SC cannot initiate any proceedings until the implementation of fundamental right is not involved, he added.

 

This is first ever constitutional petition filed against incurring of expenses in a suo motu notice case.
