Entire testimony will be disregarded if any part of it found to be false: Chief Justice
CJP's remarks came after hearing the case of false witness ASI Khizar Hayat.
ISLAMABAD (Dunya News) – Chief Justice of Pakistan Asif Saeed Khosa said on Monday that the court is beginning the journey towards truth from today.
His remarks came after hearing the case of false witness ASI Khizar Hayat.
“All the witnesses should beware. The entire testimony will disregarded if any part of it is found to be false,” he asserted.
“While taking oath, the witness says that may Allah’s wrath is sent over him if he lies. Maybe that time has arrived,” remarked the CJP.
“We are ending the false testimony culture from today. As per law, if an accused can be sentenced to death in any case then a false witness can be awarded life imprisonment,” he declared.
While talking to ASI Hayat, the CJP said, “Police record says that you were present in your deployment area in Wahdat Colony’s police station at the time of crime. Then how did you witness the incident in Narowal? Either you were not present on duty or your eye sight is so strong that it can see miles away.”
Hayat’s lawyer told court the day on which the incident occurred was of Eid.
“Is it legal to tell lie on the day of Eid?” asked the judge.
The chief justice dismissed the murder case after it was found out that it was based on a false testimony given by the police officer.
The court earlier acquitted the suspect Muhammad Illyas and summoned Hayat.
The murder occurred back on February 13, 2007 in Narowal.
