PM withdraws NAB PG's privileges; Qadir adamant

NABs prosecutor general Irfan Qadir said that the PM cannot remove him from his office and he would continue his work till the President issues a written order to remove him. A defiant Irfan Qadir came to his office and started working Irfan arrived at Nab Headquarters at 9am as usual and kept working at the Nab office of Prosecutor General. The same was confirmed by his office staff. Earlier, in a bid to avert a standoff with the judiciary, Prime Minister Syed Yousuf Raza Gilani on Tuesday issued directives to implement the Supreme Court orders regarding the of NABs prosecutor general and withdraw all the privileges enjoyed by Irfan Qadir in the same office. The PM stated that NABs PG would be appointed immediately after Eid. A serious situation was emerged yesterday when the government issued a notification, allowing Irfan Qadir to continue work as NABs prosecutor general in a serious defiance of the Supreme Courts orders to remove him. Irfan also appeared before media and said, I was legally appointed by President Asif Ali Zardari and only he could remove me and I am the Nabs Prosecutor General. Meantime, the Presidential House said the apex court ruling is quite explicit and unequivocal. Presidential spokesman Farhatullah Babar said the court has expressly directed Irfan Qadir to leave his charge and there is no truth in reports regarding directives from the president giving him go-ahead to continue his work. The SC on Wednesday (Sep 1) ruled that the appointment of the NAB prosecutor general and deputy chairman, Javed Zia Qazi, was unlawful. A three-member bench headed by Chief Justice Iftikhar Muhammad Chaudhry directed Attorney General Maulvi Anwarul Haq to ask the government to remove the NAB prosecutor general from his slot as early as possible. The court gave the verdict on a petition filed by Punjab Advocate General Harris Ahmad Khawaja who, during the course of proceedings of the Bank of Punjab scam case, challenged the appointments of Qadir and Zia Qazi. Qadir has to leave office: Justice TariqJustice (r) Tariq Mehmood, while talking to Dunya News, said that Irfan Qadir could not retain his post after the Supreme Court ruling that termed his appointment as illegal. He said that a notification by the law ministry is not needed once the SC annulled the appointment orders. He hoped that the PMs move would avert an imminent confrontation between the two main institutions of the state. SC orders are self-executing: Justice Wajihuddin Justice (r) Wajhiuddin, while talking to Dunya News, said that nobody could hinder the SC orders. He said that Irfan is may be winding up his office stuff and that is why he is attending his office. He said that the SC orders are self-executing and none could hinder them. He cautioned against defying of the highest court orders.
