SC allows Khurshid Shah to become party in NAB chief appointment case

Justice Dost Muhammad says 180 million people will rush to the court if it starts hearing everyone.

ISLAMABAD (Dunya News) - A two member bench of Supreme Court comprising Justice Khilji Arif Hussain and Justice Dost Muhammad on Thursday heard the petitions filed against appointment of Chairman National Accountability Bureau (NAB).

The court allowed Opposition Leader in National Assembly Syed Khurshid Shah to become party in the case. The bench has sought reply from Khurshid Shah’s counsel Barrister Aitzaz Ahsan.

Petitioner Imran Khan’s lawyer Hamid Khan in his arguments said that that the court gave ruling against Qamar Zaman chaudhry but he was appointed as NAB chief.

Responding to the arguments, Khurshid Shah’s lawyer Aitzaz Ahsan said that the ruling also came against Federal Tax Ombudsman Rauf Chaudhry in this case but the court rectified his appointment.

He said that word ‘muk muka’ (bargaining) was being used regarding appointment of NAB chief. He said that this word should not be used.

Meanwhile, petitioner Mehmood Akhtar Naqvi said that appointment of NAB chief was also the violation of NAB Ordinance.

In his remarks, Justice Dost Muhammad said that you transferred many powers to your elected representatives after the 2013 general elections and it is impossible for the court to hear each person as 180 million people would rush to the court if it started hearing everyone in the country.

Counsel of Interior Ministry Khawaja Harris told the court the amendments were made in the rules regarding appointment of NAB chief.

Justice Dost Muhammad remarked that approval of Establishment Division was necessary to amend the rules about appointment of civil servants.

Khawaja Harris told the court that the Law Division was responsible to look into the matter instead of Establishment Division.

The court directed petitioner Mehmood Akhtar Naqvi to appear for argument after receiving Law ministry’s response in this regard.

The court adjourned the hearing of the NAB chief appointment case for two weeks.
