The court has made president party in Asghar Khan case.
A three-member bench headed by chief justice Iftikhar Muhammad Chaudhry heard the petition filed by Asghar Khan pertaining to the disbursement of millions of rupees among politicians by ISI during 1990 elections.Making presidency as party in the case, the bench remarked that political engagements should not be held in presidency as the president is the supreme commander and constitutional chief of the country. The court said that a political party was given support from presidency in the name of national interest in the past, adding that the army had to act over presidential orders in such circumstances.Presenting arguments, Salman Akram Raja said that it was the individual act of the then president.Jawad S Khawaja responded that the ISI officials can also justify thier act with the same reason.Expressing disappointment at the absence of attorney general, the bench lamented that the court orders weren’t implemented. The case has been adjourned till October 15.
