Husband bound to pay full haq mehr mentioned in nikahnama, says SC CJ
Pakistan
The petitions were heard by a two-member bench of the Supreme Court headed by Chief Justice Yahya Afridi.
ISLAMABAD (Dunya News) – During the hearing of cases related to dowry and haq mehr, the Supreme Court of Pakistan made important observations. Chief Justice of Pakistan Yahya Afridi remarked that whatever items or amount are written as haq mehr must be paid by the husband. When a marriage is solemnized, the payments recorded in the nikahnama become legally binding.
The petitions were heard by a two-member bench of the Supreme Court headed by Chief Justice Yahya Afridi.
During the proceedings, the petitioner’s lawyer argued that 40 tolas of haq mehr was excessive and that the husband was willing to pay 20 tolas instead. The Chief Justice responded that giving a little more could resolve the matter, but added that the court could not interfere in such personal arrangements.
Later, the Supreme Court dismissed various petitions filed regarding dowry and haq mehr.
