ISLAMABAD (Web Desk/Dunya News) – Chief Justice Qazi Faez Isa on Monday ordered the officials to present the petitioner before the court after he sought to withdraw his plea through which he had demanded declaring the Feb 8 elections null and void and adjourned hearing till Feb 21. 

The chief justice ordered the SHO concerned to trace Brig (r) Ali Khan and present him before the three-member bench which also comprises Justice Muhammad Ali Mazhar and Justice Musarrat Hilali.

Making it clear that the country’s top court will hear the matter, Chief Justice Isa remarked whether such persons filed petition only to get instant fame.

While noting that Brig (r) Khan had requested to withdraw the petition on Feb 13, the very day it was filed, the court questioned as if publicity was the sole goal by resorting to such tactics.

The application was shared with the entire world through media, the chief justice noted, adding that he should come and the court would hear the matter.

In a report, the apex court was informed that the petitioner could neither be approached through the address given in the plea nor the WhatsApp service.

Later, the three-member bench issued the necessary orders which read that they would not allow anyone to use the Supreme Court for ulterior motives and issued a notice to the petitioner through the defence ministry, while adjourning further hearing till Feb 21 (Wednesday). 

Brig (r) Khan had moved the Supreme Court to get orders for a probe into alleged rigging and holding the fresh elections.
