Court orders production of Lasbela case complainant on Sh Rashid’s petition
ISLAMABAD (Dunya News) – The Islamabad High Court on Thursday, while hearing a petition filed by Awami Muslim League (AML) chief Sheikh Rashid Ahmed, raised the question that which section of the law could be invoked against using filthy and immoral language.
Justice Tariq Mehmood Jahangiri conducted hearing of the AML chief’s plea. Sheikh Rashid has moved the IHC for quashing cases against him registered in Balochistan and Sindh.
During proceedings of the case, Justice Tariq Mehmood directed counsel for the complainant that on next hearing the court should be told about the section which could be invoked against using filthy and immoral language. He also asked how a case could be registered in Sindh over a media talk made at the Poly Clinic in Islamabad. The complainant’s counsel replied that political parties had activists everywhere in the country.
Justice Jahangiri further said the FIR did not contain word threat rather it mentioned foul and immoral language. So which section of the law could be made applicable for using such a language, he asked.
The complainant's counsel contented that the case belonged to the Sindh High Court and the Islamabad High Court had no jurisdiction over the matter. The complainant counsel sought time and the request was accepted by the IHC.
The court also inquired about the complainant of case registered in Lasbela who was not present in the court. The IHC then issued orders to IG Balochistan and RPO concerned to produce the complainant of Lasbela case. Later, the court deferred hearing of the case till last week of May.
