BHC issues fresh orders to quash all cases against Azam Swati

QUETTA (Web Desk) - The Balochistan High Court (BHC) ordered on Monday the dismissal of all the cases registered against PTI leader Azam Swati for controversial tweets against army officials.

The fresh orders were issued by Justice Abdul Majeed Baloch who heard a petition related to the new cases registered against the senator in Balochistan. Three cases were registered against Mr Swati in Winder, Bela and Chaman. On Dec 9, the BHC ordered to quash all the first information reports (FIR) registered against the senator. The orders were issued by the BHC on a petition filed by the senator’s son against the registration of the cases. 

Separately, the Sindh High Court (SHC) also ordered that no cases should be registered against Mr Swati in the province in the controversial tweets case. Mr Swati’s custody was given to the Islamabad police. Sindh Prosecutor General Faiz Shah said the cases registered against the senator had been categorised as “C-class”.

“All applications are now ineffective,” said the government lawyer, adding that the cases were registered on the complaints of private citizens. The court directed that no further FIR should be registered against Mr Swati in the case. It added that multiple cases were registered against Mr Swati in different areas in the province on a single charge.

On Monday, an Islamaad special court adjourned the hearing of the bail application of the PTI leader till Tuesday. 

On Friday, a special court in the federal capital had again delayed the announcement of verdict on a post-arrest bail plea by PTI Senator Azam Swati in the controversial tweets case. The verdict was delayed as Azam Khan is yet to assume charge as special judge central Islamabad. Mr Swati’s counsel Babar Awan and special prosecutor Raja Rizwan Abbasi appeared in court but they had to return without any proceedings.

The special court is likely to announce the verdict next week as the case has been adjourned till Dec 19. Judge Azam Khan’s predecessor Raja Asif reserved the verdict on Mr Swati’s bail plea in October last. However, he was transferred to the Islamabad High Court (IHC) earlier this week.

A day earlier, a district and sessions court in Islamabad approved a 14-day extension in judicial remand of the PTI senator, hours after he was shifted to Islamabad after cases against him in Sindh disposed off as ineffective.
