Missing persons' issue earning bad name to country: CJP
The SC has rejected IG FC report in Mustafa Azam case and summoned FC commandant.
ISLAMABAD (Online) - Chief Justice of Pakistan Iftikhar Muhammad Chaudhry has remarked Pakistan will not be allowed to be ridiculed in the world owing to missing persons’ matters.
He further remarked, “On one side innocent people are picked up and on the other side the institutions which lift them deny this act.
It is better whosoever holds missing persons should inform the court about the details or they should initiate proceedings as per law. We have allowed the time to the people as much as we could give and now we will allow no more time now. FC personnel after picking up one person said he is Hamza Javed and not Mustafa Azam”.
Justice Jawwad S Khawaja remarked, “Nothing will run in the country now except rule of law and constitution.
Enough is enough and missing persons should be recovered now. As soon as we dispose of one case we come to know some more people are missing. Dead bodies of the persons who have gone missing in Balochistan are being recovered from Karachi. For how long will it continue.”
A 3-member bench of Supreme Court (SC) presided over by the CJP took up the missing persons case for hearing Thursday.
The court was informed that FIR was lodged with reference to Mustafa Azam. This young man was arrested when blast took place in Hayat Abad Peshawar. This young man was held by FC. When investigation was made it came to light that he was student of first year and he was staying in the hotel when the bomb blast occurred. Sindh police was investigating a case against him He was caught by the police during bomb blast incident at Peshawar. His father recognizes him.
The CJP remarked, “Father is recognizing his son. Mustafa Azam be presented before us.” Police told he is Hamza Javed as per their record.
Justice Azmat Saeed remarked “bomb blast took place in 2013 in Peshawar. He is missing since 2006. Orders were issued in 2007 in connection with his recovery.
CJP said to Additional Attorney General (AAG) “when you had presented this person.
Tariq Khokhar told Hamza and his sister were presented in the court. This man is held by us.
CJP observed “when you arrest people you can not release them without recording their statements and completing the formalities
The court said in its orders this thing is very clear this young man is in the custody of FC and it is duty of FC to present him before it. We want case is disposed of as soon as possible because it is pending hearing since 2007.
This young man be presented before the court on August, 22 IG FC should ensure implementation of court’s orders.
The court while rejecting again the IG FC report in Mustafa Azam missing person case has summoned FC commandant allegedly involved in his arrest.
The court also issued notice to IG Sindh and sought from him video tape of Mustafa Azam who was arrested during the bomb blast.
