Justice Hassan Azhar Rizvi dissented from the decision of Justice Mandokhail
ISLAMABAD (Dunya News) – In a recent development, the note of Justice Jamal Khan Mandokhail could not be released on the Supreme Court's website.
Justice Mandokhail had taken notice of the matter of giving the right of intra-court appeal under Article 199 and stated that the right of appeal could be given under the Presidential Ordinance under Article 199.
He also added that the right of appeal may be granted by ordinance or parliamentary legislation in matters of public importance and fundamental rights.
However, Justice Hassan Azhar Rizvi dissented from the decision of Justice Mandokhail and decided to write his own note. With the decision tied by one-one, the two-member bench referred the matter to the Chief Justice for an appropriate ruling.
This matter was pending before an eight-member larger bench.
Justice Mandokhail issued a notice to the attorney general, advocate general Punjab and Islamabad, and referred the matter to the chief justice to place it before an eight-member larger bench.
