Chief Justice Iftikhar Muhammad Chuadhry on Thursday observed that mechanism of election on reserved seats is a violation of Article 226 of the Constitution. A 17-member bench of the apex court resumed hearing of identical petitions challenging some clauses of 18th amendment on Thursday. During the course of hearing, Attorney General Maulvi Anwarul Haq said that under the 18th amendment, the party leader could get any member declared disqualified for violation of discipline. The CJ questioned that how come a person could head a party when he is ineligible to become a parliamentarian. Justice Javed Iqbal remarked that the people who have got dual citizenship could not be elected to parliament then how they have become party chiefs. Justice Shakir Ullah Jan said that the election on reserved seats should be conducted via secret ballot. The court adjourned the case till Monday.
