Summary

Sindh High Court dismissed the petition challenging President Zardaris eligibility. The court remarked that the President enjoyed immunity as per the constitution and as such he could not be tried. The petitioner Maulvi Iqbal Haider, in his petition, argued that by the time Zardari contested for presidency, certain corruption and money laundering cases were sub-judice against him in different national and international courts. He added that Zardari has been convicted in two cases as well; however the election commission accepted his nomination papers due to NRO. But now as the NRO has been scrapped, and all the cases against the president reopened, his nomination papers be reviewed against and he be declared ineligible for the post of president. However, Sindh High Court bench comprising Chief Justice Sarmad Jalal Usmani and Justice Zahid Hamid heard the case and disposed off the plea. The judges remarked that under sub-section 6 of Article 41 the president enjoyed complete immunity and as such no case could be filed against him.
