Intra-court appeal against army chief' extension dismissed

ISLAMABAD: The Islamabad High Court (IHC) dismissed an intra-court appeal over a petition relating to the extension given to Chief of Army Staff General Ashfaq Pervez Kayani.

 

A division bench of the IHC comprising Justice Mohammad Anwar Khan Kasi and Justice Shaukat Aziz Siddiqui had taken up the application filed by Col (retd) Inamur Rahim, legal adviser of the Ex-Servicemen’s Society.

 

Advocate Rahim had filed the petition in the IHC in Sept 2012 against the extension in the service of army chief, but Chief Justice Iqbal Hameedur Rehman had dismissed it on Sept 24, citing Section 3 of Article 199 of the Constitution, which says that the high courts could not hear cases pertaining to the service of armed forces personnel.

 

Then he had filed an intra-court appeal against the said order.

 

In the appeal, Rahim had contended that General Kayani was not subject to the Army Act, 1952, as he had attained 60 years of age on April 20, 2012, after which no-one could serve in the army.
