These remarks were made by the court during the Asghar Khan case hearing in the Supreme Court. CJP also observed the president is always the head of the state, and not of any political party.Secretary Aiwan-e-Sadre Malik Asif Hayat submitted his answer to the court saying no political cell has been in operation in the Presidency since 2008. On Justice Arif Khilji’s querry about the existence of any political cell prior to 2008, Malik Asif expressed his ignorance.Chief Justice said acting with impartiality was part of the oath of the president. The court also remarked that the then army chief should not have acted the way he did and the events of 1999 and November 3 could have been avoided. Justice Khilji said the distribution of money among the politicians was the individual act of General Aslam Beg and General Asad Durrani and the whole institution could not be blamed for it.Ex-brigadier Hamid Saeed was also summoned by the court but he could not appear owing to illness. On the contact by the registrar office, Hamid Saeed confirmed he would appear in the court tomorrow.
