The Supreme Court of Pakistan (SCP) on Wednesday unanimously issued detailed decision on November 3, 2007 actions taken by then President Pervez Musharraf. The 400 pages decision has been written by Chief Justice of Pakistan Justice Iftikhar Muhammad Chaudhry himself while Justice Chaudhry Ijaz Ahmad and Justice Jawad S Khawaja wrote additional notes. The decision clearly declared November 3 actions as unconstitutional, unethical and intolerable. According to the decision, Supreme Judicial Council (SJC) will take action against PCO judges under article 209. However, the decisions made by the sacked judges would not be affected. The decision has also set up a procedure to appoint judges according to which President and Governors would be bound to act upon the recommendations made by Prime Minister and Chief Ministers respectively for appointment of judges. The decision also suggested establishment of high court in the federal capital. Talking to Dunya News on the decision, former attorney general Malik Qayyum said President had been delimited to act upon the recommendations of Prime Minister provided latters suggestions did not contradict Chief Justice; Chief Ministers had no role in it. He maintained that the issue of NRO was serious and the Supreme Court would have to make a decision on it. Renowned lawyer and former provincial law minister Khalid Ranjha while Talking to Dunya News said, Pervez Musharraf himself had termed his actions as unlawful but Supreme Court had not proposed any action against him.
