FPSC reluctant to implement FST judgment

The FPSC has not withdrawn its decision of giving promotions despite FST judgment.

Despite Judgment of Federal Service Tribunal, the Federal Public Service Commission (FPSC) is reluctant to withdraw its previous decision of giving promotions to technical cadres.“The Chairman Federal Public Service Commission Rana Bhagwandas has refused to implement the judgment of Federal Service Tribunal because for implementing the judgment he will have to take back its earlier decision of giving promotions to eight non-general cadres in the general cadres,” said an official who wished not to be named.The official said that the Establishment Division is also staunch opponent to implement the judgment of Federal Service Tribunal though it has written a letter on June 11, 2012 to the Federal Public Service Commission in which directed for further necessary action in the light of the direction of the court but just four days later on June 15 the Establishment Division in another letter directed to the Commission that its earlier office memorandum should be treated as withdrawn.The Federal Service Tribunal in its May 29, 2012 judgment the Recruitment Rules 2008 and 2011 framed by Federal Public Service Commission be declared as illegal being violative of the provisions of the civil servants Act 1973.“Frustration is prevailing elsewhere among the officers and staff of Federal Public Service Commission due to newly amended recruitments rules 2008.The amendments have been made in Recruitments rules 1990,”said the official, adding that all the officials of BS-11 and above of different cadres working in the commission declared eligible for the promotion to the post of Assistant Director (BS-17) and promotion quota has also been reduced from 80 per cent to 50 per cent.The official further said that inclusion of other technical cadres in the general cadres is against the seniority Rules of 1993 as each cadres has separate line of promotion and the inclusion of all the officials in BS-11 to 15 for the promotion to the post of Assistant Director and condition of qualifying test of 300 marks is serious violation and example of discrimination among assistants and all other staff. The all other officials have been given double benefit as they were enjoying promotion benefits in their respective cadre and additionally declared eligible for promotion as Assistant Director whereas on the other hand, Assistants were not eligible for promotion to the other Posts of BS-17 exists in Federal Public Service Commission.Test/Examination for promotion posts had already suspended by the Lahore High Court and Sindh High Court in 2002 and the Establishment Division had also issued instructions to the Federal Public Service Commission not to conduct promotional Examination against the post BS-17 to 19.Despite repeated attempts to contact with Secretary Establishment Division Khoshnood Akhter Lashari and Chairman FPSC Rana Bhagwandas but they could not be contacted.
