Parliament cant legislate against constitution: CJP

Summary Chief Justice of Pakistan has said that parliament cant legislate against the constitution.

If such laws are made, the judiciary has an option of judicial review, said Iftikhar Muhammad Chaudhry.While having a meeting with delegation of youth parliamentarian, Chief Justice of Pakistan said that parliament should make such laws which may be implemented.He made it clear that the parliament can’t make such laws which are against Islam, the Constitution and fundamental principles. If any power tries to legislate against these principles, judiciary is authorized to declare it null and void by judicial review, he emphasized.He said that judicial review aims at discouraging the misuse of powers. Every institution of the state enjoys freedom within their jurisdiction; if any of them misuses its powers, it would be reviewed by the judiciary, he said.He said the Supreme Court is guarantor of fundamental rights.
