Summary SC says tax slapped on cement manufacturing in Nowshehra and Lakki Murrawat is unconstitutional.
ISLAMABAD (Online) - The Supreme Court declared void tax levied by Khyber-Pakhtunkhwa government on manufacturing, uploading and downloading of cement remarking that KP government had no authority to impose this tax.
A three member’s bench of SC headed over by the Chief Justice of Pakistan (CJP) Iftikhar Muhammad Chaudhry pronounced this judgment Thursday. Earlier this decision was reserved.
A 3-member bench of apex court led by Justice Nasir ul Mulk had heard this case and the CJP announced this judgment being Justice Nasir ul Mulk not present.
It was said in the verdict that tax slapped on cement manufacturing in Nowshehra and Lakki Murrawat was unconstitutional.
The court also annulled the notification issued by government of KPK with reference to levying of this tax.
Lucky cement had moved the court against the levying of tax on cement manufacturing.
The court while declaring the tax null and void Thursday admitted Lucky Cement Company appeal plea for hearing.
