ISLAMABAD (Dunya News) – The Federal Constitutional Court has issued an important ruling regarding the protection of women’s inheritance rights.
In its judgment in the case of a woman from Balochistan, Bibi Amina, the court stated that the Holy Quran clearly guarantees women’s right to inheritance.
It ruled that depriving any woman of this right is not only a violation of national law but also of divine injunctions.
Expressing concern, the court observed that regrettably, there is a prevailing trend in society where women are deprived of their inheritance rights, often through social pressure, coercion, threats, or fraud.
The judgment emphasized that it is the responsibility of the courts to carefully and thoroughly examine cases related to women’s inheritance to ensure that no injustice is done.
It further clarified that no regional tradition, custom, or family practice can override a woman’s legal right to inheritance.

The court annulled the judgment of the Balochistan High Court in the case and directed that all properties of the applicant’s parents be submitted before the relevant civil court for determination of shares.
It further instructed the civil court to determine legal shares in all properties in accordance with the Constitution, law, and Islamic injunctions, and to decide the matter strictly on merit.
According to details, Bibi Amina had challenged in court her brothers’ alleged failure to grant her a share in her parents’ entire property, upon which the Federal Constitutional Court issued this significant ruling on the protection of women’s inheritance rights.
