Lahore High Court upheld Rs100,000 monthly maintenance for an autistic girl, rejecting petitions seeking increase and reduction in child support amount

LAHORE (Dunya News) - The Lahore High Court has rejected petitions seeking both an increase and reduction in maintenance expenses for an autistic girl, upholding the previously fixed monthly support amount of Rs100,000.

Justice Abid Hussain Chattha issued a written verdict on petitions filed by Aliha Noorul Amin Mengal challenging the family court’s decision regarding maintenance for the autistic child.

The petitioner argued that children affected by autism require significantly higher expenses for education, treatment, and daily care compared to other children, adding that maintenance for such children should be determined under a separate standard.

According to the plea, Noorul Amin Mengal’s children from his first marriage were studying in expensive educational institutions, including Aitchison College, and his lifestyle reflected both declared and undeclared income sources.

The petition further stated that despite the father’s financial position, the family court had fixed insufficient maintenance for the autistic child.

On the other hand, counsel for Noorul Amin Mengal argued that the family court had set an excessively high maintenance amount and requested the court to reduce it to Rs50,000 per month.

In its decision, the court observed that both the family court and appellate court had examined all facts and circumstances before reaching an appropriate conclusion.

Justice Abid Hussain Chattha ruled that the Lahore High Court could not interfere in the findings of the family and appellate courts while exercising constitutional jurisdiction.
