ISLAMABAD (Web Desk) - The matter of transfer of three judges of the Islamabad High Court has now been challenged in the Supreme Court of Pakistan.
The Lahore High Court Bar Association, through senior lawyer Hamid Khan, has filed a constitutional petition taking the stance that these transfers are against the Constitution.
The petition states that the judges’ transfers violate Article 2-A of the Constitution and that there is a serious lack of transparency in the process.
It is further argued that the reasons for the transfers have not been clearly stated, raising concerns over the independence of the judicial system.
The petitioner has made the federal government and the Judicial Commission of Pakistan parties in the case and has requested the court to declare the transfer orders null and void.

It is worth noting that the issue surfaced after a notification regarding the transfer of three Islamabad High Court judges was issued on Monday, which caused concern among the legal fraternity and lawyers’ bodies.
Earlier as well, questions have been raised regarding transparency and constitutional procedure in administrative decisions related to the judiciary.
However, after being directly challenged in the Supreme Court, the legal and constitutional debate has gained further significance.
The Supreme Court is expected to examine the petition in its upcoming hearing and decide whether the judges’ transfers comply with constitutional requirements or not.
